Introduction
This privacy statement applies to the services provided by Terra Midwifery Practice via https://www.terrapraktijk.nl/. This privacy statement explains how the Terra Midwifery Practice handles the processing of personal data. In this privacy statement it is described which (categories of) personal data is collected, for which purpose this personal data is used and with which categories of recipients this personal data is shared.

Information about Terra Midwifery Practice
The Terra Midwifery Practice is located in Amsterdam and is registered with registration number 50053914 in the Trade Register of the Chamber of Commerce. From this point on the midwifery practice Terra will be referred to as “Terra Midwifery Practice.” For questions about the privacy statement the Terra Midwifery Practice can be reached on working days from 09.00-13.00 at telephone number 020-3372403.

Processing of personal data
Personal data from clients is processed by Terra Midwifery Practice for the following purposes:

  • Carry out the medical treatment agreement;
  • Administrative purposes
  • To maintain and expand the relationship with clients
    This processing is founded in:
    – the medical treatment agreement
    – consent
    – legitimate value to Terra Midwifery Practice

 

Which personal data is processed by Terra Midwifery Practice:
a. Last name, first name, initials, title, sex, birth date, address, postal code, city of residence, telephone number, e-mail address and similar details about the pregnant client and her partner necessary for communication purposes, medical data and other specific personal data, including citizen registration number (BSN), in so far as is necessary to carry out the medical treatment agreement and declare costs to the health insurer;
b. Name and address details for quality assurance and follow-up of treatment as outlined in the quality assurance framework Population Screening Act (counseling data and prenatal screening);
c. Complaints and comments about treatment from relevant parties;
d. Other data that is strictly required for the proper treatment and handling of the treatment.

The list above is not exhaustive and may vary based on the treatment agreement.

Online registration of personal data
Personal data is registered in the online midwifery registration system Orfeus which is NEN certified and complies to the privacy standards as described in the AVG act. This system is only accessible to the midwifes and assistants registered to the practice. All of these providers are legally bound to a confidentiality (professional secrecy).
Registration of the name and address, birth date, BSN number and insurance number are processed digitally for the purposes of the client database, verifying identity and submitting claims to the insurance provider.

Photo
A requested photo will only be saved to the medical records for the purposes that the midwifes and assistants can recognize a client in the context of care provision.

E-mail address
E-mail addresses are processed digitally for the purposes of sending: information regarding midwifery-related topics, confirming appointments, invitations to participate in surveys to evaluate the care provided by the midwifery practice. This is send via secure e-mail.

Sharing health status with other care providers
Data processing relating to the health status of clients in the past and present, the health status of the (future) child, the performed tests and treatment are registered for the purposes of care provision. This data is exclusively shared, after receiving consent from the client, with other care providers if this is medically necessary in order to provide care.

The secure systems, Zorgdomein or Zorgmail, are used to communicate with other care providers.
The care providers include, but are not limited to, gynecologists, clinical midwifes, pediatricians, general practitioners, ministry of health consultation office, maternity nurses and the insurance provider for claims.

Vecozo
This system is used to communicate with insurance providers.

Registering and making appointments
If you register or make an appointment via our website, the details that you have shared in the registration form or the appointment system are exclusively used for managing your registration and making an appointment.

Your personal data is processed in order to complete your registration after you have filled in the form on our website. For this reason the personal details are also required to be filled in. The legal basis for this processing is that this information processing is necessary for the legitimate interest of Terra Midwifery Practice and for you. This interest consists concretely of the interest of Terra Midwifery Practice and of you to be able to process your registration in the medical record system. This personal data is stored as long as is necessary during the full period of care provision.

Improving our services
Your personal data may be used to improve our services. This is only done if you have provided these details specifically for this purpose, or if you have given us permission for this. For example, feedback that you have shared via a complaint form or consent you have provided for the use of cookies.

Photos on our website
It is possible that the photos on our website are a form of processing personal information. This is the case when a person is displayed in the photo. In as much as necessary the relevant people will freely provide consent for the publication of these photos. With this there is also a legitimate interest of Terra Midwifery Practice to process this personal data. This interest consists of the ability to put photos on their website, to maintain the website and the right to freedom of expression. The photo may be displayed on the website as long as Terra Midwifery Practice considers the photo to be of added value to the website.

Third-party Websites
This privacy statement does not apply to third-party websites that are shared by links and thereby connected to the Terra website. We are not able to guarantee that these third-party sites have a reliable and secure way of procession personal data. For this reason we recommend you read the privacy statements of these websites prior to using them.

Retention period
The medical records are saved for 15 years as legally required by the Medical Treatment Agreement Act. Additional personal details shared, such as participation in information sessions, are destroyed immediately after use. Sent birth announcements and cards will be hung for a maximum of 6 months in the public waiting room of the practice and will then be destroyed.

Cookies
Our website makes use of cookies. A cookie is a small text file when visiting the website for the first time that is saved to the browser of your computer, tablet or smart phone. This ensures that the website functions correctly and that for example your preferred settings are saved.

These cookies are also used to ensure the website functions well and that this can be optimized. When you visit the website for the first time we inform you about these cookies and ask permission for their use. You can decline the use of these cookies by setting your internet browser so it no longer saves cookies. In addition you are able to delete all information that has previously been saved by doing this under the settings of your browser.

Google Analytics
In the case that we have activated the Google Analytics tool, our website will then place cookies from the American company Google, as part of the Analytics service. We use this service to track and receive reports regarding how visitors use the website. This tool is set to be privacy friendly. In this way we have not given Google permission to use the obtained Analytics information for other Google services, we have allowed our IP-addresses to be pseudonymized and we have signed off on a processing agreement with Google.

The information that is collected by Google is transferred and saved to servers in the United States. Google states that it upholds the Privacy Shield principles and adheres to the Privacy Shield program of the American Department of Trade. This means that there is an appropriate level of privacy for the processing of personal data.

Security
Terra Midwifery Practice has taken technical and organization measures to ensure a level of security appropriate to the risk. In this way the website https://www.terrapraktijk.nl/ is secured with a SSL-certificate. The sending of personal details is therefore done with a secure connection. In addition, e-mails are sent through e-mail servers that are specifically secure for healthcare. The additional technical companies with which we work are NEN7510 certified.

Processors and other third parties
The personal data that you provide to us may be shared with third parties if this is necessary to accomplish the goals as described above.

We do not share any personal data with other parties with which we do not have a processing agreement with. With these parties (processors or those responsible for processing) we will of course make the necessary agreements to protect the security of your personal data. In addition we will not share the personal data you have provided with other parties unless this is legally required and allowed.

Personal data may be shared or access may be granted to the following parties:
Researches as described in article 7:458 of the Civil Code;
Insurance provides in as far as is necessary according to requirements described in the insurance agreement;
Third parties responsible for collecting progress insofar as access/provision is necessary and does not concern medical data;
Others, when the foundation of the processed data is:
Consent of the concerned party;
A need to uphold a legal requirement;
Safeguarding a vital interest of the concerned party.

Others, when the further processing is for historical, statistic or scientific purposes, if the responsible party has taken the necessary measures to ensure that the further processing is exclusively for these purposes.

Inside the EU
We do not share personal data with parties that are located outside of the EEA, a country or international organization where there has not been a decision of adequacy taken, or a country with which there is no legally binding and enforceable instrument.

Your privacy rights
You have the right to view, rectify or delete the personal information that we have received from you. You can also object to the procession of your personal details (or part of this) by us or by one of our processors. You also have the right to have your provided information transferred by us to yourself or if instructed by you to transfer this to a third party. We may ask you to confirm your identity before we are able to comply with these requests.

If you provide consent to process your personal data, you always maintain the right to withdraw your consent.
In some situations we may not be able to comply completely with the withdrawal of your consent because we have a legally mandated retention period. In this case we will also inform you about this.
